Unemployment question?

My husband was fired from his job a few months ago. The reasons are completely false and we have proof. His former employer has been firing employees over the last year and each one of them after a lengthy process was able to get unemployment. It comes down to this, his former employer%26#039;s business is hurting and he%26#039;s firing vs laying off so that it%26#039;s more difficult for the former employees to get unemployment. I understand that each employee that gets unemployment makes his rates higher. My question is if every employee that he fires gets unemployment does the employer get in trouble? Any other info in regards to this is appreciated.

it doesn%26#039;t matter if the employer is laying off or firing people, you are still entitled to unemployment if you meet the requirement. Now what may be happening is the employer is denying benefits when the unemployment office contacts them. Then they have to make a determination. If this happens too often he will be looked at carefully.

The issue with getting unemployment after a firing vs. laying off is that when you are fired from a job, it%26#039;s usually because you broke some type of rule or committed an action clearly against company policy. When people fight for the unemployment it%26#039;s on them to prove they were fired in error, thus the long wait. Then...when they do receive unemployment, it%26#039;s not for as long or as much as if they were layed off through no fault of their own. It is likely your local unemployment office is too backlogged to really investigate anything, so they simply process the forms and payout to the people requesting. There probably is also a certain % who don%26#039;t fight or find a job too quick to ever get unemployment.



My advice...life is too short, find something else and move on. Unemployment is a nightmare to deal with.
